How workers' comp works
Workers' compensation is a state-run, largely no-fault system. You generally don't need to prove your employer was at fault, but in most cases you cannot sue your employer directly. Report your injury to your employer quickly, as deadlines apply. Lawyers' fees are usually a percentage of benefits, capped and approved under state law.
Questions to ask a workers' compensation lawyer
- Have I reported my injury in time, and what should I do next?
- What benefits should I be getting while I am off work?
- Can I see my own doctor?
- Is your fee capped or approved by the state?
